海洋保护区制度与中国海洋安全利益关系辨析

大会第七次会议上，决定将国家管辖范围外海洋生物多样性问题纳入专门计划，并要

求 CBD 在支持《联合国海洋法公约》基础上建立海洋保护区制度； 2008 年 CBD
缔约方大会第九次会议上，通过了《确定公海水域和深海生境中需要加以保护的具有
重要生态或生物学意义的海域的科学准则》和《建立包括公海和深海生境在内的代表

性海洋保护区网络选址的科学指导意见》； 2011 年特设工作组向大会提议，应在

《联合国海洋法公约》框架下制定新的多边协议； 2015 年联合国大会第 69 次大会

通过决议，正式就制定保护公海生物多样性条约启动谈判； 2017 年 7 月，《国家
管辖范围以外区域海洋生物多样性问题执行协定》第四次预备委员会向联大提交了最
终建议性文本草案《海洋生物多样性养护和可持续利用的具有法律约束力的国际文书

建议草案》，并计划到 2020 年上半年的第四次会议期间形成最终协定文本。
公海保护区又可分为两类，一类是在闭海与半闭海中的公海区域设立海洋保
护区，另一类是在开阔的区域中设立海洋保护区。相比之下，前者由于国家间距
离相近而利益紧密，所以达成协议的困难相对较小，例如，法国、意大利和摩纳

哥共同设立了地中海派拉格斯海洋保护区、南极海洋生物资源养护委员会设立了
南奥克尼群岛海洋保护区、《东北大西洋海洋环境保护公约》委员会设立了大西
洋中央海脊海洋保护区。因此，目前在谈判时屡遇障碍的主要是第二种保护区，
